Mustafa Rewards Application (App) Terms and Conditions

These Terms and Conditions govern your participation in the Mustafa Rewards Application (App) operated by MUSTAFA’S PTE. LTD. (UEN: 198000780C), with its registered address at 145 Syed Alwi Rd, Mustafa Centre, Singapore 207704, and its related company, MOHAMED MUSTAFA & SAMSUDDIN CO. PTE LTD (UEN: 198900680Z), with its registered address at 668 Chander Road, #02-18, Singapore 210668, (collectively, Mustafa, we, our, us). By registering, accessing or using the App, you agree to be legally bound by these Terms.

Please read these Terms and Conditions carefully before using this App.

By using our App you accept these terms and conditions

By clicking “I Agree, downloading, installing, registering for, accessing or using the App in any manner, you acknowledge that you have read, understood and agree to be legally bound by these terms (Terms and Conditions). If you do not agree to these Terms, you must immediately cease all use of the App.

If you do not agree to these Terms and Conditions, please do not use our App in any way.

We recommend that you print a copy of these Terms and Conditions for future reference.

Rules of Usage

Membership eligibility and registration:-

To be eligible for membership in the Mustafa Membership Programme (Programme) through the App, an individual must:

be at least 18 years of age;
possess a valid mobile number that can receive SMS and WhatsApp messages and notifications, in particular, you will need to provide a valid and unique email address for registration and a valid mobile phone number for mandatory 2-Factor Authentication (2FA) process;
provide accurate and complete registration information as required.

Mustafa reserves the right to approve or reject any membership registration request, provided that such discretion shall be exercised reasonably and in accordance with applicable laws. Mustafa shall notify the applicant of its decision within five (5) working days of receiving a complete registration request.

Members must provide accurate, complete and up-to-date information at registration. Each mobile number and email address can only be linked to one account. Members are responsible for maintaining the confidentiality of their login credentials and are liable for all activities under their account.

We may, in our sole and absolute discretion, suspend, terminate or deactivate your account with immediate effect and without prior notice if: (a) you have provided false, incomplete or misleading information; (b) you attempt to manipulate, circumvent or abuse the App’s systems or features; (c) you engage in any fraudulent, unlawful or prohibited activity; (d) your account remains inactive (defined as no logins or points transactions) for a continuous period of 24 months; or (e) you breach any provision of these Terms. Upon such suspension, termination or deactivation, all accumulated Points and benefits shall be automatically forfeited without compensation, and you shall have no claim against Mustafa.

Points Accumulation:-

You may be issued Points which can be redeemed for various rewards.

Points are earned on qualifying purchases made at participating Mustafa outlets, including Mustafa Centre and Mustafa Jewellery (excluding gold bars). A Member ID must be scanned at the Point-of-Sale (POS) during the transaction for points to be recorded. Points are typically credited within 7 working days but may take longer under special circumstances.

Points will not be awarded for:

Refunded or cancelled purchases;
Purchases where the Member ID was not scanned; and
Items or categories explicitly excluded by Mustafa.

Points currently have no expiration date. However, Mustafa reserves the right to implement an expiration policy for Points upon providing at least 30 days’ prior written notice to Members through the App or registered email address.

Digital Vouchers:-

Points Collection Process:-

Points Collection Through Purchases: Customers will collect 1 point for every $1 spent at participating stores. For example, a spend of $250 will earn the customer 250 points.

Cumulative Point Collection and Wheel Spins: The point collection and wheel spin chances are cumulative. This means that for every $250 spent, customers will:

Collect points based on their purchase amount.
Get a chance to spin the wheel for additional points.
Earn one entry into the Mustafa Rewards Lucky Draw.

Points collected can be redeemed when a unique barcode is generated on the app.

Points Redemption Process:

Members may choose to redeem vouchers by selecting the vouchers they want to redeem and spending the appropriate amount of points. A unique Barcode will be generated and must be presented at checkout. Points redeemed will be deducted from the member’s wallet. Mustafa may make other points redemption processes available to the Members from time to time at its sole discretion.

Points Usage Limitation:

Points cannot be transferred, sold, exchanged for cash, or used in conjunction with other promotional offers unless explicitly permitted by Mustafa in writing.
Cannot be used on excluded items or e-commerce platforms unless explicitly permitted by Mustafa in writing.

We may, at our sole discretion, organise a rewards Lucky draw from time to time. We reserve the right to determine the accumulated spend for each entry of the Lucky Draw.

Only registered app members with verified mobile numbers are eligible. Each entry must be associated with a valid purchase made within the draw’s qualifying period. Entry eligibility and criteria is at our sole discretion.

Winners will be selected through an independently audited system. Winners will be notified via WhatsApp, email, and published on our website and in selected newspapers. Winners must:

Present photo ID;
Provide their original winning entry code and Winner’s invitation in the application;
Confirm their identification as the owner of the registered phone number with the Rewards App account;
Collect prizes in person (unless otherwise specified).

Prizes from the Lucky Draw are non-transferable and must be collected within 60 days. Unclaimed prizes will be forfeited and donated to a charitable organisation. Participation in the Mustafa Rewards Lucky Draw constitutes consent to publicity activities including photography and media appearances.

Spin the Wheel

Members may receive spins based on in-store purchases or campaign participation. Prizes include points, promotional vouchers or Mustafa Rewards Lucky Draw entries. All outcomes are determined by a random, independently audited algorithm, and are final and non-disputable.

The prizes to be won will be displayed on the virtual wheel, which will come to a stop randomly based on certain pre-set algorithms that have been audited and verified by a Certified Public Accountant to be a fair system, with logic put in place to ensure sure-win randomisation prize award to members and is in compliance with Gambling Control (Trade and Other Promotional Games and Lotteries — Class Licence) Order 2022

Mustafa’s absolute discretion

Notwithstanding any other provision in these Terms, Mustafa shall have sole, absolute and unfettered discretion in: (a) determining the issuance, calculation, adjustment or cancellation of Points, prizes, or rewards; (b) interpreting, applying and enforcing these Terms; (c) resolving any disputes related to the Program; and (d) modifying, suspending or terminating the Program or any part thereof. While Mustafa shall endeavor to exercise its discretion reasonably and in good faith, Members irrevocably acknowledge and agree that Mustafa’s decisions shall be final, binding and conclusive, and shall not be subject to review or appeal. For clarity, nothing in these Terms creates any obligation for Mustafa to issue any specific rewards, maintain any specific redemption rates, or continue Mustafa expressly reserves all rights not specifically granted under these Terms or to discontinue the Program indefinitely.

2.6 In- App Games

The App may include games (such as a “Lucky Spin”) where rewards may be won by you. The eligibility of rewards from these games are based on a specific criteria to be set by us at our sole and absolute discretion. We reserve the right to void, cancel, terminate any game, reward, spin or entry into such games including but not limited to technical malfunction of the App, bug, fraud, scam, exploitation or any usage of the App in bad faith. Our decision on all game outcomes and rewards is final, conclusive and binding.

2.7 Mustafa Rewards Lucky Draw Rules

Subject to our sole discretion as set out at Clause 2.5, the Mustafa Rewards Lucky Draw Rules are as follows:-

Members can enter this Mustafa Rewards Lucky Draw by making a Qualifying Purchase and by being a member of the Mustafa Rewards App.
There is no maximum qualifying purchase. A qualifying purchase entitles you to one entry into the Mustafa Rewards Lucky Draw.
For the purposes of entry into the Mustafa Rewards Lucky Draw, purchases made on multiple receipts from Mustafa Centre or Mustafa Jewellery (excluding gold bars) can be combined to form an entry. If you qualify for participation in the Mustafa Rewards Lucky Draw, it will be automatically added into your Mustafa Rewards Account within forty eight (48) hours if you scan your Mustafa Rewards Member ID at the cashier while making the purchase.
No additional payment is necessary to enter the Mustafa Rewards Lucky Draw.

By submitting an entry for the Mustafa Rewards Lucky Draw, you confirm that:-

You are the natural person named on the entry and that you are not submitting the entry on behalf of anyone else, regardless of whether or not you have received their consent.
You confirm and understand that you have read and understood these terms and conditions and agree to be bound by them.
We accept no responsibility for entries not successfully completed due to technical faults, malfunctions, human error, computer hardware or software failures, satellite network or server failure of any kind.

3.2 Timing of Earning and Redemption

We may make changes to these Terms and Conditions

We may amend these Terms and Conditions from time to time. Every time you use our App, please check these Terms and Conditions to ensure you understand the applicable Terms and Conditions.

You may determine if any such amendment has taken place by referring to the date on which these Terms and Conditions were last updated. Your continued use of our App constitutes your acknowledgement and acceptance of such changes.

We may modify, suspend or withdraw our App

We reserve the right to update or modify our App from time to time. We do not guarantee that our App, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our App at any time without ascribing any reasons.

You are also responsible for ensuring that all persons who access our App through your internet connection are aware of these Terms and Conditions and any other applicable terms, and that they comply with them.

Proprietary rights

This App is owned and operated by MUSTAFA’S PTE LTD operating the Mustafa Centre and Mustafa Jewellery Brand.

The materials and content on this App, including the information as well as any software or code made available on or through this App (the Contents), are protected by copyright, trademark and other forms of intellectual property and other proprietary rights. All rights, title and interest in the Contents are owned by, licensed to or controlled by us.

Access to our App

You agree to comply with any and all terms, guidelines, notices, policies, and instructions pertaining to the use and/or access of our App, as well as any amendments, issued by us, from time to time.

You may not adapt, alter or circumvent the systems or Contents in connection with our App, nor access our App other than through normal methods. You may not deface, defame, post unlawful content or in any way unlawfully access, block or limit access to our App.

Failure to comply with these Terms and Conditions may result in our taking of actions we reasonably deem appropriate, including any or all of the following actions:

immediate, temporary or permanent withdrawal of your use of our App;
immediate, temporary or permanent removal of any posting or material uploaded by you to our App;
issue of a warning to you;
issue of legal proceedings against you (including, but not limited to, damages and reasonable administrative and legal costs) resulting from your non-compliance; and/or
disclosure of such information to law enforcement authorities and any other authorities in any country.

All disclaimers, indemnities and exclusions in these Terms and Conditions shall survive termination of your agreement to the Terms and conditions for any reason.

Restrictions on use of materials

Except as otherwise provided, the Contents of this App shall not be reproduced, republished, uploaded, posted, transmitted or otherwise distributed in any way, without our prior written permission.

You must not use any part of the Contents of this App for commercial purposes without obtaining a licence to do so from us or our licensors.

Modification of any of the Contents or use of the Contents for any other purpose will be a violation of Mustafa’s Pte. Ltd.’s copyright and other intellectual property rights as well as a breach of the applicable laws. Graphics and images on this App are protected by copyright and may not be reproduced or appropriated in any manner without the written permission of their respective copyright owners.

If you copy or download any part of our App in breach of these Terms and Conditions, your access to our App will be terminated immediately and you must, at our option, return or destroy any copies of the Contents you have made.

Disclaimer of liability

The Contents of this App are provided on an “as is” basis without warranties of any kind. To the fullest extent permitted by law, we do not warrant and hereby disclaim any warranty:

as to the accuracy, correctness, reliability, timeliness, non-infringement, title, merchantability or fitness for any particular purpose of the App and the Contents of this App;
that the App, Contents available through this App or any functions associated therewith will be uninterrupted or error-free, or that defects will be corrected or that this App and the server will be free of all bugs, viruses and/or other harmful elements; and
any delays and/or failures arising from OTP delivery, technical failures or POS integration.

To the maximum extent permitted under applicable law, we shall not be liable for any loss, damage, cost, expense or liability of any kind (whether direct, indirect, special, incidental, consequential, punitive or exemplary), including without limitation, loss of profits, revenue, business, opportunity, data, goodwill or anticipated savings, howsoever caused and regardless of the form of action, whether in contract, tort (including negligence), strict liability or otherwise, arising out of or in connection with: (a) the use of, or inability to use, the App; (b) any reliance placed on the Contents; (c) any system, server or connection failure, error, omission, interruption, delay in transmission, or computer virus; or (d) any use of or access to any other website or mobile application linked to the App. You acknowledge that this limitation of liability is an essential basis of the bargain between you and Mustafa, without which Mustafa would not have made the App available to you.

The Contents of this App do not constitute financial, legal or other professional advice. If financial, legal or other professional advice is required, services of a competent professional should be sought.

You are responsible for configuring your information technology, computer programmes and platform to access our App. You should use your own virus protection software.

Although we make reasonable efforts to update the information on our App, we make no representations, warranties or guarantees, whether express or implied, that the Contents on our App are accurate, complete or up-to-date.

You must keep your account details safe

If you choose, or you are provided with, a user identification code, password, PIN, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party and any unauthorised access of your account following such disclosure is at your own risk.

We have the right to disable any user identification code or password, whether chosen by you or allocated by use, at any time if, in our reasonable opinion, you have failed to comply with any of the provisions of these Terms and Conditions, if it is in our interests to do so or if required by law.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify change your password and login details. You may request that we suspend your account at mustafarewards.app and we may, after reasonable investigation, take necessary action solely at our discretion.

We are not responsible for Apps we link to

Where our App contains links to other Apps and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval or endorsement by us of those linked Apps or information you may obtain from them. We have no control over the contents of those Apps or resources. When you click on a third-party link, you will leave our App. Any personal data you submit on the resulting site will not be collected or controlled by us but will be subject to the privacy policy or terms of use of the resulting site.

We are not responsible for third party content

Our App may contain third party content, including but not limited to comments and articles posted by third parties, the content of advertisements posted by third parties, applications posted by third parties and content accessed through such applications. You agree that we shall not be responsible or liable for any third-party content on our App or your access or use of any third-party content on our App.

Rules about linking to our App

You may not establish a link to our App without our express written consent. Even if consent is provided, you may only establish a link to the home page or to any other page on our App in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

We reserve the right to withdraw linking permission without notice.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our App, or to make contact with other users of our App, you must comply with our content standards as well as any applicable laws.

You warrant that any such contribution complies with those standards and all applicable laws, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

We also have the right to disclose your personal data to any third party who is claiming any content you posted or uploaded to our App constitutes a violation of their intellectual property rights or of their right to privacy, in accordance with our Privacy Policy https://mustafarewards.app/privacy-policy/.

We, as the administrator of the App, maintain the absolute and unfettered right to remove, modify, or disable access to any posting, content, or links you make on or to our App (Removal Action), at our sole and complete discretion, without any prior notice or liability to you. Our decision regarding any Removal Action shall be final and binding, and you hereby irrevocably waive any right to challenge, appeal, or dispute such decision through any means or in any forum. We shall not be liable for any loss or damage arising from any Removal Action.

Governing law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore. By using or clicking “I Agree”, registering access or using our App, you agree that the Singapore courts will have exclusive jurisdiction.

General

A failure by us to exercise or enforce any rights conferred upon us by these Terms and Conditions shall not be deemed to be a waiver or variation of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.

If any provision of these Terms and Conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms and Conditions shall not be affected.

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 2001 of Singapore to enforce any of these Terms and Conditions, and the application of the Contracts (Rights of Third Parties) Act 2001 of Singapore is expressly excluded.

We may, at any time and without obtaining your prior consent, assign, transfer, novate, or otherwise dispose of all or any of our rights, obligations, or liabilities under these Terms and Conditions to any party (Permitted Assignment). You hereby irrevocably consent to any such Permitted Assignment and agree to be bound by these Terms and Conditions in favor of any assignee or transferee. You shall not assign, transfer, novate, sub-license, or otherwise dispose of any of your rights, obligations, liabilities or under these Terms and Conditions without our prior written consent, which may be withheld at our absolute discretion.
